File Upload and Processing

When you upload an image to our platform:

  1. You keep full ownership of your content.
  2. We only process your content to provide the Service.
  3. Your content is never used to train any AI model.
  4. Your files are stored on Cloudflare infrastructure that meets GDPR requirements.

Image Retention Policy

Your files are deleted automatically:

  1. Free upscaled images are stored for no longer than 24 hours.
  2. Paid upscaled images are stored for up to 14 days even if the customer does not delete them manually.

We cannot guarantee that file uploads or processing will be error-free or uninterrupted.

6. Intellectual Property

All software, technology, design, logos, trademarks, and other content used in the Service are owned by or licensed to the Company. You may not copy, distribute, modify, or create derivative works without our written permission.

7. Third-Party Services

We use third-party providers for storage, analytics, payments, and authentication. These include Cloudflare, Stripe or PayPal, and Google OAuth. Your use of these features is subject to their separate policies. We are not responsible for the performance or security practices of these third-party services.

8. Limitation of Liability

To the maximum extent permitted by law, the Company and its directors, employees, and agents are not liable for:

  1. Any indirect, incidental, special, or consequential damages.
  2. Loss of data, loss of revenue, or business interruptions.
  3. Issues caused by your device, internet provider, or third-party failures.

Our total liability for any claim related to your use of the Service will not exceed the amount you paid to us in the twelve months before the claim was filed.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted, error-free, or meet your expectations. We do not guarantee that any defects will be corrected.

10. Termination

We may suspend or terminate your account or access to the Service at any time if we believe you violated these Terms. Upon termination, your account may be deleted and you will lose access to your content.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of Estonia. Any dispute arising from these Terms will be subject to the jurisdiction of the courts of Tallinn, Estonia. You agree that all legal proceedings will be conducted in English.

14. Refund Policy

We want you to be satisfied with your purchase. Refunds may be issued in the following cases:

  1. You were charged in error.
  2. You experienced a verified technical issue that prevented successful use of purchased credits.

Refunds are not provided for:

  1. Unused credits after cancellation or renewal.
  2. Dissatisfaction with model output when the Service functioned correctly.
  3. Promotional or free credits.
  4. Credits that the user deletes from their own account. User-initiated deletion of credits does not qualify for a refund under any circumstances.

Processing Time

We review refund requests within 3 to 5 business days. If approved, we issue the refund immediately.

Funds Return Timeline

Payment processors may take 5 to 10 business days to return the funds. Your bank may take additional time to post them.

How to Request a Refund

Email support@oneupscaler.com using the same email linked to your account. Provide:

  1. Your account email
  2. Payment receipt or transaction ID
  3. Charge date and amount
  4. Reason for the request
